Habitats Regulations Consultations
Amendments are being made to the Habitats Regulations to reflect recent clarification of the status of land-use plans as ‘plans or projects’ under Article 6(3) and 4 of the Habitats Directive.
Natural England is currently awaiting further guidance on how Habitats Regulations assessment procedures will need to be applied specifically in the case of Local Development Frameworks. In general terms, this means that if a land-use plan is likely to have a significant effect, alone or in combination, on one or more European sites (Special Areas of Conservation, Special Protection Areas) it must be subject to an ‘appropriate assessment’. Please speak to your local adviser within the appropriate Government Team for further information.
